These Terms and Conditions ("Terms") govern the use of the kuulweb.com website and the services offered by KUUL WEB ("we", "our"). By using this site or hiring our services, you agree to these Terms. If you do not agree, please do not use the site or hire our services.

1. Who we are

KUUL WEB is a website design and development service provider, headquartered in Murfreesboro, Tennessee, United States, offering subscription plans and related services such as digital ad management and loyalty programs.

2. Description of services

We offer website design, development, hosting, and maintenance, as well as optional digital marketing services (including managing ads on third-party platforms like Meta) and loyalty programs through external providers. The exact scope of each service is defined by the plan hired or the specific proposal agreed upon with the client.

3. Plans and pricing

Prices published on the site are subject to change without prior notice, but any change will not affect contracts already active during a paid period. Plans are billed according to the model indicated at the time of hiring (one-time setup payment plus monthly subscription). Some plans carry a mandatory minimum commitment period (see the plans section for the specific minimum term of each plan).

4. Payments

Payments are processed through our external payment provider (Stripe). KUUL WEB does not directly store full credit or debit card data. It is the client's responsibility to keep their payment information up to date to avoid service interruptions.

5. Cancellations and refunds

The client may cancel their monthly subscription after completing the minimum term agreed to at the time the contract was signed. Initial setup payments are non-refundable once development work has started, unless otherwise agreed. Monthly payments already billed are also non-refundable on a prorated basis, unless expressly agreed. The maintenance fee is a flat rate of $120 (USD). This amount is subject to change. Maintenance is not required — only if the client requests it.

6. Ownership of the delivered website

Once the corresponding payment is completed, the client owns the specific content of their business (own text, images, information) included on the site. KUUL WEB's underlying code, templates, reusable components, and methodology remain the intellectual property of KUUL WEB, unless otherwise agreed in writing.

7. Acceptable use

The client agrees not to use KUUL WEB's websites and services for illegal, fraudulent, defamatory activities, or activities that infringe on third-party rights. KUUL WEB reserves the right to suspend service in the event of use that violates this condition.

8. Third-party services

Some services (hosting, payment processing, Meta ad management, WhatsApp messaging, conversational artificial intelligence, loyalty cards) depend on third-party platforms. KUUL WEB does not control or guarantee the availability, terms, or policies of these external platforms, and is not responsible for interruptions caused by such third parties.

9. Limitation of liability

KUUL WEB does not guarantee specific sales, traffic, or ranking results from the use of the website. To the maximum extent permitted by applicable law, KUUL WEB will not be liable for indirect, incidental, or consequential damages arising from the use or inability to use our services.

10. Changes to these Terms

We may update these Terms periodically. Changes take effect upon posting on this page. Continued use of our services after an update constitutes acceptance of the new Terms.

11. Governing law

These Terms are governed by the laws of the State of Tennessee, United States. Any dispute will be resolved before the competent courts of that jurisdiction, unless applicable law provides otherwise.
